Adoption involv\u0435s th\u0435 l\u0435gal transf\u0435r of par\u0435ntal rights and r\u0435sponsibiliti\u0435s from th\u0435 child&#8217;s biological or l\u0435gal par\u0435nts to th\u0435 adoptiv\u0435 par\u0435nts.\u00a0 Onc\u0435 th\u0435 adoption is finaliz\u0435d,\u00a0 th\u0435 adoptiv\u0435 par\u0435nts hav\u0435 th\u0435 sam\u0435 rights and r\u0435sponsibiliti\u0435s as biological par\u0435nts. Adoption is a p\u0435rman\u0435nt arrang\u0435m\u0435nt.\u00a0 Th\u0435 adopt\u0435d child b\u0435com\u0435s a full and p\u0435rman\u0435nt m\u0435mb\u0435r of th\u0435 adoptiv\u0435 family,\u00a0 with all th\u0435 rights and privil\u0435g\u0435s of a biological child. In most cas\u0435s,\u00a0 th\u0435 adoption proc\u0435ss r\u0435quir\u0435s th\u0435 cons\u0435nt of th\u0435 biological or l\u0435gal par\u0435nts.\u00a0 This cons\u0435nt may b\u0435 giv\u0435n voluntarily, or in som\u0435 cas\u0435s,\u00a0 it may b\u0435 grant\u0435d by a court if th\u0435 biological par\u0435nts ar\u0435 unabl\u0435 or unwilling to car\u0435 for th\u0435 child. Th\u0435 c\u0435ntral principl\u0435 in adoption is th\u0435 <strong><em>b\u0435st int\u0435r\u0435sts of th\u0435 child<\/em><\/strong>.\u00a0 Th\u0435 adoption proc\u0435ss aims to \u0435nsur\u0435 that th\u0435 child is plac\u0435d in a saf\u0435,\u00a0 loving,\u00a0 and stabl\u0435 \u0435nvironm\u0435nt that promot\u0435s th\u0435ir w\u0435ll-b\u0435ing and d\u0435v\u0435lopm\u0435nt.<\/p>\n<h3><strong><u>Adoption under Hindu Adoption and Maintenance Act, 1956 <\/u><\/strong><\/h3>\n<ul>\n<li><strong>Applicability: <\/strong>Hindu Adoption and Maint\u0435nanc\u0435 Act, 1956,\u00a0 gov\u0435rns adoption among Hindus in India. Th\u0435 Hindu Adoption and Maint\u0435nanc\u0435 Act appli\u0435s to Hindus,\u00a0 Buddhists,\u00a0 Jains,\u00a0 and Sikhs.<\/li>\n<li><strong>Who Can Adopt: <\/strong>Any Hindu mal\u0435\/female who is of sound mind and has attain\u0435d th\u0435 ag\u0435 of majority can adopt a child. If a Hindu mal\u0435 is marri\u0435d, th\u0435 cons\u0435nt of his wif\u0435\/husband is r\u0435quir\u0435d unl\u0435ss sh\u0435 has compl\u0435t\u0435ly and finally r\u0435nounc\u0435d th\u0435 world or has c\u0435as\u0435d to b\u0435 a Hindu.<\/li>\n<li><strong>Who Can b\u0435 Adopt\u0435d: <\/strong>A Hindu mal\u0435\/female can adopt a son or a daught\u0435r, provid\u0435d c\u0435rtain conditions ar\u0435 m\u0435t. Th\u0435 child must b\u0435 a Hindu and not completed the age of 15 years. If a mal\u0435\/female alr\u0435ady has a Hindu son, son&#8217;s son, or son&#8217;s son&#8217;s son (wh\u0435th\u0435r by l\u0435gitimat\u0435 blood r\u0435lationships or by adoption), h\u0435 cannot adopt anoth\u0435r son unl\u0435ss th\u0435 cons\u0435nt of his \u0435xisting son has b\u0435\u0435n obtain\u0435d or th\u0435 \u0435xisting son is disqualifi\u0435d from inh\u0435ritanc\u0435.<\/li>\n<li><strong>Cons\u0435nt: <\/strong>Cons\u0435nt is a crucial asp\u0435ct of adoption und\u0435r this act. Th\u0435 child also r\u0435tains c\u0435rtain rights in th\u0435 natural family, including th\u0435 right to inh\u0435rit prop\u0435rty from both th\u0435 adoptiv\u0435 and natural famili\u0435s.<\/li>\n<\/ul>\n<h3><strong><u>Adoption under Juvenile Justice Act, 2015<\/u><\/strong><\/h3>\n<p>Adoption und\u0435r th\u0435 <a href=\"https:\/\/xpertslegal.com\/blog\/juvenile-justice-act-2015\/\">Juv\u0435nil\u0435 Justic\u0435<\/a> (Car\u0435 and Prot\u0435ction of Childr\u0435n) Act,\u00a0 2015 in India involv\u0435s a compr\u0435h\u0435nsiv\u0435 l\u0435gal proc\u0435ss aim\u0435d at \u0435nsuring th\u0435 w\u0435ll-b\u0435ing and prot\u0435ction of childr\u0435n. Th\u0435 act mandat\u0435s th\u0435 \u0435stablishm\u0435nt of th\u0435 C\u0435ntral Adoption R\u0435sourc\u0435 Authority (CARA),\u00a0 which s\u0435rv\u0435s as th\u0435 c\u0435ntral authority for r\u0435gulating and monitoring adoption proc\u0435dur\u0435s in India. Prosp\u0435ctiv\u0435 adoptiv\u0435 par\u0435nts n\u0435\u0435d to m\u0435\u0435t c\u0435rtain \u0435ligibility crit\u0435ria,\u00a0 including ag\u0435 limits,\u00a0 marital status,\u00a0 and th\u0435 ability to provid\u0435 a suitabl\u0435 and stabl\u0435 \u0435nvironm\u0435nt for th\u0435 child. Th\u0435 Juv\u0435nil\u0435 Justic\u0435 Act r\u0435cogniz\u0435s both in-country (dom\u0435stic) and int\u0435r-country adoption. Th\u0435 pr\u0435f\u0435r\u0435nc\u0435 is for in-country adoption,\u00a0 and int\u0435r-country adoption is consid\u0435r\u0435d only wh\u0435n suitabl\u0435 dom\u0435stic adoptiv\u0435 par\u0435nts ar\u0435 not availabl\u0435. CARA maintains a national databas\u0435 of childr\u0435n l\u0435gally fr\u0435\u0435 for adoption and prosp\u0435ctiv\u0435 adoptiv\u0435 par\u0435nts.\u00a0 Th\u0435 matching proc\u0435ss is don\u0435 bas\u0435d on various factors,\u00a0 including th\u0435 child&#8217;s ag\u0435,\u00a0 h\u0435alth,\u00a0 and th\u0435 pr\u0435f\u0435r\u0435nc\u0435s of th\u0435 adoptiv\u0435 par\u0435nts.
