{"id":3297,"date":"2025-08-29T15:27:09","date_gmt":"2025-08-29T09:57:09","guid":{"rendered":"https:\/\/xpertslegal.com\/blog\/?p=3297"},"modified":"2025-08-29T15:27:09","modified_gmt":"2025-08-29T09:57:09","slug":"merit-over-gender-sc-orders-equal-opportunity-for-women-in-army-legal-branch","status":"publish","type":"post","link":"https:\/\/xpertslegal.com\/blog\/merit-over-gender-sc-orders-equal-opportunity-for-women-in-army-legal-branch\/","title":{"rendered":"Merit Over Gender SC Orders Equal Opportunity for Women in Army Legal Branch"},"content":{"rendered":"<h1><strong>Arshnoor Kaur &amp; Anr.(Petitioners) vs, The Union of India &amp; Ors.(Respondents)<\/strong><\/h1>\n<p>WRIT PETITION (C) NO. 772 OF 2023<\/p>\n<p>(Mr. Manmohan and Mr. Dipankar Datta, JJ, delivered by Manmohan, J)<\/p>\n<p>Petitioners,\u00a0both law graduates,\u00a0Arshnoor Kaur and Aastha Tyagi,\u00a0had\u00a0filed\u00a0for the 31st Short Service Commission (JAG) Course in October 2023.\u00a0In\u00a0the recruitment process, the Army\u00a0had\u00a0different\u00a0vacancies\u00a0allotted\u00a0for\u00a0males\u00a0and\u00a0females. For the 31st JAG course,\u00a0there were\u00a0six vacancies\u00a0for\u00a0males\u00a0and three for\u00a0females.<\/p>\n<p>The\u00a0process of\u00a0selection\u00a0was merit-based\u00a0across\u00a0each gender category.\u00a0Under\u00a0the women&#8217;s merit list, the petitioners\u00a0were\u00a0ranked\u00a04th and 5th, respectively.\u00a0Although\u00a0both had\u00a0greater\u00a0merit\u00a0marks\u00a0than some of the male candidates who were selected\u00a0under\u00a0the men&#8217;s category, they were\u00a0rejected\u00a0because\u00a0the women&#8217;s quota was\u00a0only\u00a0up\u00a0to\u00a0three seats.<\/p>\n<p>The petitioners\u00a0went\u00a0to\u00a0the Supreme Court\u00a0on\u00a0the strength of\u00a0Article 32 of the Constitution,\u00a0claiming\u00a0a violation of their fundamental rights under Articles 14, 15, and 16.\u00a0The\u00a0petitioners\u00a0contended\u00a0that it\u00a0falls\u00a0under\u00a0gender discrimination in vacancies and that\u00a0gender-neutral recruitment\u00a0is required. The petitioners\u00a0submitted\u00a0that there was no\u00a0legislative\u00a0mandate\u00a0to impose\u00a0vacancy restrictions\u00a0based on gender\u00a0in the JAG branch. They\u00a0complained\u00a0of\u00a0a lack of\u00a0reasonableness\u00a0and that the\u00a0whole\u00a0system was\u00a0capricious.<\/p>\n<p>The Union of India and the Indian Army\u00a0argued\u00a0that the\u00a0allotment\u00a0of vacancies between men and women was a policy\u00a0issue.\u00a0Historically, the Army had\u00a0maintained\u00a0a\u00a0balance between the\u00a0ratio\u00a0of men and women in\u00a0various\u00a0units to\u00a0ensure\u00a0equal representation. The\u00a0Army\u00a0highlighted\u00a0the fact\u00a0that the recruitment was competitive and\u00a0in\u00a0line\u00a0with\u00a0available\u00a0vacancies.\u00a0Ranking\u00a0higher\u00a0than\u00a0certain\u00a0candidates in\u00a0a\u00a0different\u00a0category (men&#8217;s list) did not\u00a0confer\u00a0anyone\u00a0with\u00a0an\u00a0automatic\u00a0right of\u00a0admission.<\/p>\n<p>The\u00a0Court\u00a0looked\u00a0at\u00a0Section 12 of the Army Act, 1950, which\u00a0provides\u00a0for\u00a0women&#8217;s\u00a0eligibility\u00a0for appointment in the regular Army in such corps, departments, branches, or services as the Central Government may\u00a0detail. It\u00a0was observed\u00a0that no provision under the Act or Rules\u00a0had\u00a0fixed\u00a0gender-based numerical\u00a0quotas\u00a0within a\u00a0particular\u00a0branch\u00a0after\u00a0women were\u00a0permitted\u00a0entry.<\/p>\n<p>The Army relied on\u00a0internal circulars for\u00a02011 and 2012\u00a0that\u00a0mandated\u00a0distinct\u00a0vacancy\u00a0provisions\u00a0for\u00a0women\u00a0and\u00a0men\u00a0in the JAG branch. The Court\u00a0ruled\u00a0these were administrative instructions\u00a0and\u00a0not statutory rules, and\u00a0therefore\u00a0could not\u00a0be\u00a0used\u00a0to\u00a0trump\u00a0constitutionally guaranteed\u00a0equality.<\/p>\n<p>The Court\u00a0stressed\u00a0merit should be the\u00a0only\u00a0basis\u00a0for selection in competitive recruitment,\u00a0particularly\u00a0in non-combat\u00a0positions\u00a0like\u00a0JAG. It\u00a0pointed\u00a0out\u00a0that the petitioners were more meritorious than\u00a0many\u00a0male candidates who were inducted\u00a0but\u00a0were excluded\u00a0merely\u00a0because\u00a0of\u00a0their gender category.<\/p>\n<p>The Court\u00a0reaffirmed\u00a0the constitutional\u00a0directive\u00a0under Articles 14 and 16 that\u00a0guarantees\u00a0equality of opportunity in\u00a0government\u00a0employment. A policy\u00a0that\u00a0keeps\u00a0fewer\u00a0jobs\u00a0reserved\u00a0for women without a\u00a0valid\u00a0and\u00a0compelling\u00a0reason\u00a0is\u00a0tantamount\u00a0to indirect discrimination. The Army\u2019s argument that limiting women\u2019s intake was necessary for operational reasons did not convince the Court. It was observed that women officers had already served in the JAG branch performing the same duties as men.<\/p>\n<p>The court held that Petitioner No. 1, Arshnoor Kaur, continued to be eligible and directed the Union of India to induct her into the next available JAG training course. Petitioner No. 2, Aastha Tyagi, who had already joined the Indian Navy during the pendency of the case, was granted no further relief. The Court also said that the Army\u2019s policy of maintaining separate numerical caps for men and women in JAG recruitment was unconstitutional.
