GAVAI, CJI<\/strong>)<\/p>\n<p>&nbsp;<\/p>\n<p>In a landmark judgment delivered on May 20, 2025, the Supreme Court of India introduced sweeping reforms in judicial recruitment and promotion through a unified ruling in the All India Judges Association v. Union of India case. A bench comprising Chief Justice of India BR Gavai and Justices AG Masih and K Vinod Chandran issued directives aimed at enhancing the quality and efficiency of the lower judiciary.<\/p>\n<p>One of the most significant aspects of the judgment is the mandatory requirement of a minimum of three years of legal practice for candidates aspiring to become Civil Judges (Junior Division). The Court directed all High Courts and State Governments to amend their judicial service rules within six months to incorporate this eligibility criterion. The Court clarified that the requirement will only apply prospectively and will not impact recruitment processes already underway.<\/p>\n<p>The judgment emphasized that hands-on courtroom experience is crucial for young judicial officers who are expected to decide on matters involving life, liberty, and property from the very first day of their appointment. The bench noted that practical exposure equips candidates with better temperament, decision-making skills, and understanding of judicial responsibilities. The experience will be counted from the date of provisional enrollment with the Bar and can also include time spent working as a law clerk. Furthermore, selected candidates must undergo one year of compulsory training before presiding in court.<\/p>\n<p>In the same judgment, the Supreme Court also overhauled the promotion structure for Civil Judges (Senior Division) through the Limited Departmental Competitive Examination (LDCE). It raised the quota for promotion to District Judge from 10% to 25%, restoring the benchmark originally set in the 2002 \u201cThird AIJA Case\u201d and later reduced in 2010 due to lack of eligible candidates. The Court found that with a sufficient number of qualified judicial officers now available, restoring the 25% quota would serve as an incentive and fast-track promotion route for meritorious officers.<\/p>\n<p>Additionally, the Court reduced the qualifying service for Civil Judges (Senior Division) to appear for LDCE from five to three years. It also mandated that 10% of posts in the Senior Division cadre be reserved for accelerated promotion from Junior Division judges with at least three years of experience. To uphold merit-based promotions, the High Courts have been instructed to design appropriate tests to evaluate legal knowledge and continued efficiency.<\/p>\n<p>To ensure consistency, the Court directed that State Governments and High Courts amend their service rules so that LDCE vacancies are calculated based on overall cadre strength, ensuring uniform application across all jurisdictions.<\/p>\n<p>This consolidated judgment marks a major shift in India\u2019s judicial landscape, prioritizing practical legal experience for entry into judicial service and introducing performance-driven promotion mechanisms.
