NAGAPRASANNA<\/strong>)<\/p>\n<p>&nbsp;<\/p>\n<p>The Karnataka High Court ruled that a caste certificate cannot be canceled solely because a sibling obtained a scholarship under a different caste category. This decision was made by the Dharwad Bench while hearing a writ petition filed by a man whose caste certificate had been revoked on such grounds.<\/p>\n<p>A Single Bench of Justice M. Nagaprasanna observed that the petitioner\u2019s caste status, which had been validated multiple times, could not be negated merely because his brother secured a scholarship by falsely claiming to belong to a different caste. The Court emphasized that an individual\u2019s caste status is determined through due inquiry and cannot be altered by an unrelated act of another family member.<\/p>\n<p>The petitioner belonged to the Hindu Bhovi caste, also known as \u2018Vaddar\u2019. His school leaving certificates, along with those of his brother and sister, identified them as Hindu Bhovi. The Tahsildar conducted a local inquiry, prepared a panchanama, and issued a caste certificate confirming the petitioner\u2019s Hindu Bhovi status. However, the petitioner\u2019s brother later joined a private college and obtained a scholarship under the Hindu Sunagar caste category. Based on this, the District Caste Verification Committee (DCVC) denied the petitioner a validation certificate, suspecting fraud in his caste claim. This led to the cancellation of his caste certificate.<\/p>\n<p>The petitioner challenged this decision before the High Court, which initially remitted the matter back to the DCVC for fresh inquiry. The Deputy Director of the Social Welfare Department subsequently conducted an inquiry, confirming the petitioner\u2019s Hindu Bhovi caste status. Despite verifying school records and prior validation, another report by the Tahsildar concluded that the petitioner belonged to Sunagar-Bhovi, leading to the rejection of the validation certificate. After the Appellate Authority dismissed his appeal, the petitioner approached the High Court again.<\/p>\n<p>The High Court noted that while granting the petitioner\u2019s caste certificate, school documents had been thoroughly examined multiple times, including during re-validation processes. The same verification process applied to the petitioner\u2019s brother and sister, and all were consistently classified as Hindu Bhovi. The Court questioned the inconsistency in the authorities&#8217; approach, pointing out that the Tahsildar had initially granted the caste certificate after due inquiry. The subsequent assertion by another Tahsildar that the initial certificate was issued erroneously was deemed baseless by the Court.<\/p>\n<p>Justice Nagaprasanna stressed that the authorities could not arbitrarily revoke a person\u2019s caste certificate based on an unrelated act by a sibling. The petitioner\u2019s caste status had been repeatedly verified and affirmed, and the mere fact that his brother falsely obtained a scholarship under a different caste category did not change this fact.<\/p>\n<p>The Karnataka High Court ruled in favor of the petitioner, quashing the order that canceled his caste certificate. The judgment reaffirmed that caste certificates must be assessed on individual merit and due process rather than external influences such as a sibling\u2019s fraudulent claim for benefits.
