No(s). 786 of 2024<\/p>\n<p>(2JB, B.R. GAVAI and SANDEEP MEHTA JJ.)<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Facts:<\/u><\/strong> The instant appeals are directed against the orders of even date, i.e., 12th December, 2023 passed by the learned Single Judge of High Court of Madhya Pradesh Bench at Gwalior in Miscellaneous Criminal Case Nos. 43154 of 2023 and 43149 of 2023, whereby the bail granted to the appellants was cancelled on applications filed by the State under Section 439(2) of Code of Criminal\u00a0\u00a0 Procedure, 1973 (hereinafter\u00a0\u00a0 being\u00a0\u00a0 referred\u00a0\u00a0 to\u00a0\u00a0 as \u2018CrPC\u2019). The learned Single Judge after referring to the judgment rendered by this Court in the case of <strong><em>Abdul Basit @ Raju\u00a0\u00a0 and\u00a0\u00a0 Others\u00a0\u00a0 v.\u00a0\u00a0 Mohd.\u00a0\u00a0 Abdul\u00a0\u00a0 Kadir\u00a0\u00a0 Chaudhary\u00a0\u00a0 and Another<\/em><\/strong>, cancelled\u00a0\u00a0 the\u00a0\u00a0 bail\u00a0\u00a0 granted\u00a0\u00a0 to\u00a0\u00a0 the\u00a0\u00a0 appellants\u00a0\u00a0 by\u00a0\u00a0 a coordinate Single Bench of the Gwalior Bench of the Madhya Pradesh High Court.<\/p>\n<p><strong><u>Issue:<\/u><\/strong> Whether the high court\u2019s order cancelling bail of the appellant is valid in law?<\/p>\n<p><strong><u>Held:<\/u><\/strong> The court allowed the present appeal and held that, \u201c<em>Having heard and considered the submissions advanced by learned\u00a0\u00a0 counsel\u00a0\u00a0 for\u00a0\u00a0 the\u00a0\u00a0 parties\u00a0\u00a0 and\u00a0\u00a0 after\u00a0\u00a0 going\u00a0\u00a0 through\u00a0\u00a0 the impugned orders dated 12th\u00a0 December, 2023 and so also the orders\u00a0\u00a0 granting\u00a0\u00a0 bail\u00a0\u00a0 dated\u00a0\u00a0 8th\u00a0 September,\u00a0\u00a0 2022\u00a0\u00a0 and\u00a0\u00a0 14th September, 2022, we are of the firm opinion that the exercise of jurisdiction by the learned Single Judge of High Court of Madhya Pradesh\u00a0\u00a0 in\u00a0\u00a0 cancelling\u00a0\u00a0 the\u00a0\u00a0 bail\u00a0\u00a0 granted\u00a0\u00a0 to\u00a0\u00a0 the\u00a0\u00a0 appellants\u00a0\u00a0 by another Single Judge of the same High Court and that too, by examining the merits of the allegations was totally uncalled for and tantamount to judicial impropriety\/indiscipline.\u201d<\/em><\/p>\n<p>The court further observed that, <em>\u201cUnder normal circumstances, the\u00a0\u00a0 application\u00a0\u00a0 for cancellation of bail filed on merits as opposed to violation of the conditions of the bail order should have been placed before the same learned Single Judge who had granted bail to the accused. The learned Single Judge, while passing the impugned orders dated\u00a0\u00a0 12th December, 2023\u00a0\u00a0 has\u00a0\u00a0 virtually\u00a0\u00a0 reviewed\u00a0\u00a0 the\u00a0\u00a0 orders granting bail to the appellants dated 8th September, 2022 and 14th September, 2022 by another Single Judge of the same High Court.\u00a0 We feel that such exercise of jurisdiction tantamounted to gross impropriety.\u201d<\/em><\/p>\n\n","protected":false},"excerpt":{"rendered":"<p>HIMANSHU SHARMA\u00a0 [APPELLANT(S)]\u00a0 \u00a0Vs.\u00a0 \u00a0STATE OF MADHYA PRADESH [RESPONDENT(S)] CRIMINAL APPEAL Arising out of SLP(Crl.)
